If you are planning on filing for Chapter 7 or Chapter 13 bankruptcy, the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 states that you must complete a Certified Pre-Filing Counseling Session with an approved Non-Profit counseling agency.
If you have recently filed Chapter 7 or Chapter 13 bankruptcy, the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 states that you must complete a Certified Post-Filing Debtor Education Course with an approved agency.
Bankruptcy law requires you to obtain a Certificate of Counseling before filing your paperwork with the court. This is where we come in. Once you are registered, we will email you instructions as to how to proceed, making this as painless and fool proof as we can. The required information we need will include your assets, creditors and an estimated monthly budget. Once you’ve entered this information online, we will have a brief follow up conversation to provide support, suggestions or important insights for your household spending. Do not think this is a time for us to pass judgment or criticize your spending. This is an opportunity to discuss a better way to let your money work for you and to minimize financial stress going into the future. Once this portion of the process is complete, we will email Certificate(s) of Counseling to you and, if you should decide to use one, to your attorney.
Again, Bankruptcy law will require you to earn a Certificate of Education before it finalizes the bankruptcy process. We can provide this to you also. This is the easy part of the process, but it does require a minimum of two hours of reading online. You will read eight short chapters with a 4-question quiz at the end of each. At the end of the eighth chapter there is a 20-question test. For those with test anxiety, don’t worry, we’ll help all we can. Once you are finished, we upload your Certificate(s) of Education to the district bankruptcy court and again email the Certificate(s) to you and, if you are using one, to your attorney.
